Why Zelensky vetoes law on confiscating assets of sanctioned persons

President Volodymyr Zelenskyy returned the law "On Amendments to Certain Laws of Ukraine on Improving the Effectiveness of Sanctions Related to the Assets of Individuals" (bill No. 7194) to Parliament with his proposals. The draft, submitted by a group of deputies, was passed by the Rada on April 21 and sent to the President for signature on April 22.

The law imposes a new type of sanctions — recovery of assets belonging to an individual or legal entity to the State, as well as assets that it can directly or indirectly dispose of.

Zelenskyy noted that the law:

  • does not provide clear criteria by which a person can be classified as one of those who are subject to such a sanction. This does not meet the requirements of the Constitution of Ukraine;
  • gives the National Agency on Corruption Prevention (NACP) new powers regarding the identification and search of assets subject to blocking that belong to individuals and legal entities specified in the decisions of the National Security and Defense Council. These powers go beyond the NACP competence, as defined by the Law "On Corruption Prevention";
  • proposes to supplement the law "On Sanctions" with provisions on carrying out administrative proceedings by the Higher Anti-Corruption Court (HACC) in cases of applying a sanction through the recovery of assets to the State. At the same time, it does not provide for making appropriate amendments to the law on HACC that determines the organization foundations and activities of this court.

Therefore, the President returned this law with his proposals to the Parliament for reconsideration in the session hall.
